Question: My mother is ailing, and I believe that it is critical for me to take off time from work to help her. My boss has told me that she understands the situation but would like me to be at work as much as possible. Can I get fired for taking a leave of absence? – F.S., Hawthorne Answer: California law allows workers who meet certain criteria to take a leave of absence of up to 12 weeks during a one-year period if a parent is undergoing treatment in a hospital, hospice or other health-care facility. The leave of absence often is unpaid (although health insurance will continue), but a program known as Paid Family Leave might come into play. There are criteria to qualify for leave, whether paid or unpaid. Typically the employee has to have been employed by the employer for a set period of time, logged a certain amount of hours and be working for an employer with 50 or more employees. My first thought, therefore, is to make sure you know your rights. So, I encourage you to talk with an attorney. My second thought is for you to then talk things out with your employer to learn what may be available (or what the employer might do for you). A Web site that summarizes the basics is published by the California Department of Fair Employment & Housing (www.dfeh.ca.gov). Type phrases such as “Paid Family Leave” or “Family Care Leave” in the search box. In terms of whether or not you could be fired for taking a leave of absence, I would have to learn more about your employer and your employment. Most employees are “at will” and can be let go without cause. On the other hand, you may well have rights you can exercise, and firing you would be improper. So, once again I recommend you find your way to suitable counsel. Q: Do I need a license to fish off the pier? – K.G., Redondo Beach A: No, in California you do not need a license if you are fishing off a public pier. Q: Our divorce is just about final. It dawned on me that my will lists my husband both as an executor and a beneficiary in the event of my death. Does that still apply once he is no longer my husband? – D.L., Rolling Hills Estates A: Unless your will provides otherwise, the divorce revokes any provision which names your ex-spouse as an executor or a beneficiary (California Probate Code Section 6l22). But this does not apply to the beneficiary designations for individual retirement accounts, or for life insurance. Those would have to be changed. Personal property lien When you obtain judgment against someone, such as in Small Claims Court, you are allowed to record an Abstract of Judgment in the County Records that will be a lien on the debtor’s real property, but you also may file a personal property lien with the California Secretary of State’s Office. The personal property lien attaches to non-exempt personal property sufficient to satisfy the judgment, and thus can be another tool in seeking to collect on the judgment. Lottie gets a view from space!British ESA astronaut Tim Peake has tweeted a message from space about the Donegal Stargazer Lottie doll.Stargazer Lottie is in the International Space Station with the British European Space Agency astronaut, in an effort to promote STEM and get children interested in astronomy and science.Peake shared an image of Stargazer Lottie in space from his official social media accounts. The Special Edition ‘Gold Collection’ ‘Stargazer’ Lottie doll is a collaboration with the European Space Agency, and is currently being exhibited at the BTHA London Toy Fair at the Olympia.Astronaut Tim PeakeStargazer Lottie traveled to the International Space Station along with British ESA astronaut Peake on the 15th of December 2015, having travelled ahead on board Orbital ATK’s “S.S.
